Terms of Service

1. Agreement to Terms

By accessing or using the Ekkle platform, including the website at ekkle.app, its subdomains, the Ekkle mobile application, and any church-branded white-label applications (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration

To access most features, you must create an account. You agree to provide accurate and complete information, keep your login credentials confidential, and notify us immediately if you suspect unauthorized access. You are responsible for all activity under your account.

4. Church Communities

The Service allows you to join church communities. Each church community is managed by its own administrators, who set rules and moderate content within their community. Ekkle provides the platform but does not control the day-to-day decisions of individual church administrators.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Harass, abuse, threaten, or intimidate other users.
  • Upload content that is hateful, violent, obscene, or infringes on the rights of others.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems.
  • Use the Service to send spam or unsolicited messages.
  • Interfere with or disrupt the Service or its infrastructure.
  • Reverse-engineer, decompile, or disassemble any part of the Service.

6. User Content

You retain ownership of content you submit to the Service (“User Content”). By submitting User Content, you grant Ekkle a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content as necessary to provide the Service. You represent that you have the right to share any content you upload.

7. Donations & Payments

Donations made through the Service are processed by Stripe. Donation transactions are between you and the receiving church. Ekkle facilitates the transaction but is not the recipient of your donation. All donations are subject to the receiving church's refund and receipting policies. Ekkle is not responsible for tax deductibility; consult your tax advisor.

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Ekkle and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

9. White-Label Apps

Churches using Ekkle's white-label program may have branded iOS applications published under their church's name. These apps are powered by the Ekkle platform and governed by these same Terms. Church administrators are responsible for the content and moderation within their community but not for the underlying platform infrastructure.

10. Third-Party Platform Connections

The Service offers optional integrations with third-party platforms, including—but not limited to—YouTube (operated by Google LLC) and Facebook (operated by Meta Platforms, Inc.), so that a church administrator can automatically forward the church's live broadcast to those platforms.

By connecting a YouTube channel, you authorize Ekkle to access and use YouTube data on your behalf and you agree to be bound by YouTube's Terms of Service and Google's Privacy Policy. By connecting a Facebook Page, you authorize Ekkle to access and use Meta platform data on your behalf and you agree to be bound by Meta's Terms of Service and Meta's Privacy Policy.

You represent that you have all rights and authority necessary to connect the YouTube channel(s) and/or Facebook Page(s) you choose, and that broadcasting your church's content to those destinations does not violate any third-party rights or the platform's rules. Ekkle is not responsible for the availability, behavior, content moderation, or policies of third-party platforms, including any decision by those platforms to suspend, restrict, or terminate your stream or account.

You may disconnect any third-party integration at any time from the church admin panel. The exact data retained by Ekkle and by the third party after disconnect is described in our Privacy Policy.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may delete your account at any time through the app settings, and you may disconnect any third-party platform integration described in Section 10 at any time from the church admin panel. Upon termination or disconnection, your right to use the Service or the relevant integration ceases immediately. Data deletion follows our Privacy Policy.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

13. Limitation of Liability

To the fullest extent permitted by law, Ekkle shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

15. Changes to Terms

We may revise these Terms at any time. Material changes will be communicated through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
